From surfboards, skis, licorice, and coffee stir sticks to vascular catheters, fiber optic connectors, pharmaceutical formulations, and surgical techniques – Dave Kujawa gets patents granted for his clients. 

He also has extensive litigation experience, including experience with Hatch-Waxman litigations and complex/joint defense litigations.  As third chair in a trial involving infusion pumps, he helped win summary judgment of infringement for Kimberly-Clark and a favorable settlement after just two days of trial.

In addition, Dave’s enjoyed recent successes in Patent Board proceedings including interferences and inter partes reviews.  He helped save a patent after the Board instituted review and defeated another attack before a review was instituted.

Dave graduated with honors from UC San Diego where he majored in bioengineering and minored in physiology.  After college, Dave worked for four years at the Scripps Research Institute in La Jolla, where he conducted research on catalytic antibodies.  He later worked at an intellectual property law firm in Pasadena, CA, attended Loyola Law School at night, and graduated in the top 10% of his class.  Dave was a summer associate at the firm in 2009 and joined the firm as an associate in 2010.

  • Anderson v. Kimberly-Clark Corp., 2:12-cv-1979 (W.D. Wash.): Represented defendant in a design patent infringement matter regarding adult diapers.
  • Bern Unlimited, Inc. v. Easton-Bell Sports, Inc., et al., 11-12278 (D. Mass): Assisted defendant in a trade dress infringement matter regarding protective helmets.
  • Intelligent Bio-Systems, Inc. v. Illumina Cambridge Limited; IPR 2013-0128, IPR 2013-0266, & IPR 2013-0517: Assisting patent owner in several inter partes reviews before the PTAB by defending technology involving DNA sequencing.
  • GlaxoSmithKline v. Anchen Pharmaceuticals et al., Case No. 11-046 (RGA) (MPT) (2011).  Represented the Anchen defendants in patent infringement action in the District of Delaware on a patent relating to pharmaceutical compositions of dutasteride (the active ingredient in GSK’s Avodart® product) and a combination of dutasteride and tamsulosin (the active ingredients in GSK's Jalyn® product).  Achieved favorable case-dispositive settlement for client.
  • Novartis Pharmaceuticals Corp. et al.  v. Wockhardt LLC USA et al., 12-03967 (D.N.J.)  Representing defendant Wockhardt in patent infringement action in the District of New Jersey.
  • I-Flow LLC et al. v. Progressive Medical, Inc., 12-01064 (C.D. Cal.) Representing plaintiff I-Flow in a patent infringement action in the Central District of California.
